STIHL Recalls Chain Saws Due to Risk of Injury

The CPSC, in cooperation with STIHL announced a voluntary recall of the MS 391 Chain Saw. It is advised that consumers immediately stop using the product until otherwise notified. All distributors must stop selling the product.

STIHL Inc has voluntarily recalled their MS 391 chain saws due to the potential of cracking of the flywheel on the chain saw. This can cause parts of the flywheel to separate and may cause injury.

While there are no reported injuries at this time, it is highly recommended that you stop using the STIHL MS 391 gas-powered chain saws with an orange top casing, gray base and black front handle and hand guard. “STIHL” and “MS 391″ are printed in an orange circle on the starter side of the unit.

Below are the serial numbers which are located on the crackcase to the right of the muffler. These serial numbers include:

28535 1759 through 28535 1956
28664 5278 through 28664 6277
28665 1283 through 28665 5577
28724 4317 through 28724 4480
28735 3627 through 28735 3647

The product was sold at STIHL dealers nationwide from March 2011 through July 2011. Consumers are asked to immediately stop using the chain saws and return them to an authorized STIHL dealer. They will provide installation of a new replacement flywheel.

Latest Recall from NHTSA

The National Highway Traffic Safety Administration is alerting consumers of a recall involving 13,792 Evenflo Maestro child safety seats. In the event of a crash, a crack could form at the front of the seat, adjacent to the harness adjuster, causing the child to be improperly restrained.

Evenflo is recalling the child seats with model numbers beginning with 310. Those include 3101198; 3101980; 31011048; 31011049; 31011059 produced between November 24, 2009, and April 9, 2010. The model number and the manufacture date are located on a label on the side of the car seat/carrier.

To fix the problem, Evenflo is providing consumers with a metal reinforcement plate to provide additional structural support in the area of the harness adjuster. Owners of the affected seats should contact Evenflo at (1-800-233-5921) immediately to obtain a free reinforcement plate. The seat should not be used with children weighing under 40 pounds without the repair bracket. Children who weigh more than 40 pounds can continue to use the seat as a belt-positioning booster until the remedy kit arrives.

Parents and caregivers are also encouraged to sign up with NHTSA to automatically receive updates about child seat recalls via e-mail. Consumers may sign-up for recall notifications from the federal government by visiting here at www.safercar.gov and choosing the “e-mail” or “RSS” option to register.

Dorel Juvenile Group (DJG) is recalling their child safety seats. The reason for the recall is because the harness lock and release button does not always return to its locked position. A button that is not in the locked position can allow the harness adjustment strap to slip back through the adjuster as a child moves around in the seat and results in a loose harness, increasing the risk of being injured a motor vehicle accident.

DJG said the problem involves certain restraint systems manufactured from May 1, 2008, through April 30, 2009, which have a “Center Front Adjuster” (CFA) for the harness. These include infant, convertible, and booster child restraint systems which were sold both as stand-alone seats or part of a travel system (with a stroller).

DJG said it intends to provide consumers with a remedy kit consisting of a small tube of non-toxic, food-grade lubricant to be applied to the CFA to prevent sticking and allow it to properly engage the CFA strap. Instruction on how to apply the lubricant will be provided, along with a label to indicate that the repair has been completed.

Until the remedy has been applied, consumers can continue to use the seats, however, parents and caregivers should make sure the harness is properly adjusted and the lock/release button is fully in the locked position. After adjustment, pull on the shoulder part of the harness to make sure it is secure and does not loosen.

NHTSA began a formal investigation of this issue on March 5, 2010, and indicated it would continue to keep the investigation open to further evaluate the adequacy of the recall scope.

Latest Settled Case

PrimeCare Medical, a North County prison health coordinator, recently settled 36 lawsuits due to prison conditions. Reports indicate that 36 inmates contracted methicillin-resistant Staphylococcus aureus (MRSA).

MRSA is a bacteria infection that is most commonly caught during hospital stays. MRSA symptoms include chills, chest pain, cough, fatigue, fever, Muscle aches, rashes and shortness of breath. The lawsuit was more than three years old as they were filed in 2007. The suits were filed by a Philadelphia law firm out of Philadelphia.

The defense argued that there was no evidence to prove that the conditions within the prison caused the outbreak of MRSA. The plaintiffs argued that the conditions within the prison were unacceptable. The suit provided allegations that the conditions of the prison directly caused the outbreak. Among the allegations within the complaint included overcrowded conditions, leaking roofs, dirty drinking water, infestation of cochroaches, sewage backup and moldy bathrooms.

The terms of the settlement were not released.

LawLeaf can provide settlement funding to clients that have recently filed suit or have already settled a lawsuit. If you don’t have the financial ability to sustain until you receive proceeds from your claim, LawLeaf can assist you. For additional information on a settlement loan, contact LawLeaf today.

If you have been recently injured due to a product recall and have legal representation from an attorney, you may qualify for lawsuit funding with LawLeaf. At LawLeaf, we provide clients throughout the United States with lawsuit cash advances against product liability and defective product claims. Many of these plaintiffs were injured due to a faulty product.

There are thousands of class action lawsuits that are filed each year throughout the United States. Class action lawsuits are generally against those companies that have developed an unsafe product without sufficient testing released the product for sale. These types of lawsuits are oftentimes against multi-million & billion dollar companies that have deep pockets and large defense teams. This means they have the resources to hold up a lawsuit in hopes for much smaller payouts and in some cases no payouts at all. As a plaintiff you could be waiting for years for a settlement and worst case scenario having the lawsuit go into litigation and make it to court.

If you are currently going through a class action lawsuit or have hired an attorney to singly take on a product liability claim due to a product recall, you may not have the financial staying power to continue the litigation process. Much like class action lawsuits, these companies can hold up a claim for years before closure. For some people that are financially incapable of waiting months or even years for a settlement, may be forced into taking much less.

At LawLeaf we understand that some people can’t financially sustain without an income coming into the household. For some people who have loss wages or have lost the ability to work, may not have the financial capacity to pay ongoing bills for medical expenses or worse yet their mortgage or rent. If you are currently searching for an alternative to a premature settlement, contact LawLeaf today regarding a lawsuit loan against your case.

LawLeaf is currently providing both pre settlement funding and post settlement funding for product recall lawsuits.
